Who we are

mydreamholiday is powered by Leisure Options (Pty) Ltd (registration no. 1988/007026/07; Fidelity Fund Certificate F114530) (LO), a private company of 310 Main Road, Bryanston, which is also our address for service of legal documents; tel 011 267 8300; hello@mydreamholiday.co.za. LO is bound by the PPRA Code of Conduct for property practitioners. LO operates as the facilitator and auctioneer under its registration with the Property Practitioners Regulatory Authority (PPRA). We are not the owner, seller or buyer of any timeshare, and we are not a party to the sale.

How a sale works

Sellers list their timeshare and sign a Seller Mandate appointing us to market and facilitate the sale. A buyer who wins an auction, or whose purchase is agreed, pays the full amount into LO's FNB Section 54 trust account: the purchase price, the buyer's commission, the admin fee and the managing body's transfer fee. Buyers pay only through our secure checkout on the website, or through a payment request on mydreamholiday (a secure CallPay link shown on the buyer's dashboard and on the listing) — we never send payment links or bank details any other way. Everything the buyer pays is held in trust as client money until the ownership transfer is registered and the 3-day period for the buyer or seller to raise a problem has passed. LO then earns its fees, pays the transfer fee over to the managing body, and pays the seller the sale price less the seller commission and the payment-processing fee. A problem means that what was registered does not match the sale, for example the wrong week, module, half or points, a floating week in the wrong season or room type, or arrears or levies that were not disclosed, raised in writing through the dashboard or to support@mydreamholiday.co.za within the 3 days. If a problem is raised, LO keeps the money in trust until the buyer and seller agree in writing how it is to be paid, or a court, ombud or arbitrator decides, and then pays it out on that basis.

Verification

Every listing's ownership and levy position is confirmed by the managing body that keeps the ownership register before it goes live (or, for stock it lists itself, by that body or its management company on its written authority). LO verifies the identity of every seller and buyer. LO may edit a listing for formatting, or decline or remove a listing. Review is not a guarantee of accuracy — the seller is responsible for what they declare.

Fees & commission

Fees are shown before you commit. The buyer pays the buyer's commission and the admin fee together with the purchase price. The seller commission and a payment-processing fee are deducted from the sale proceeds at settlement, after transfer; there is no upfront fee to list. VAT applies only to LO's fees (the buyer's commission, the admin fee, the seller commission and the payment-processing fee) and is included in them; no VAT is charged on the purchase price or the transfer fee. Commission is never tied to credit approval.

Refunds

If the sale cannot go ahead for a reason that is not the buyer's fault — for example because the managing body refuses the transfer, a right of first refusal is exercised, or the seller cannot transfer — the buyer gets back everything they paid, fees included. If it cannot go ahead because the buyer refuses or fails to do what the transfer needs within 14 days of being asked, the price and the transfer fee are refunded and LO keeps its buyer's fee. An auction win and an accepted offer are binding: the buyer cannot cancel them because they change their mind. A fixed-price (Buy-Now) purchase carries a 7-day cooling-off period from the day the buyer secures the listing, and if they cancel in that period LO refunds everything they paid, in full, within 30 days.

Auctions

Bids are binding. Every auction is subject to the seller's reserve unless the listing says otherwise, and neither the seller nor LO, nor anyone acting for either of them, may bid. If the reserve is met, the highest bid concludes the sale. The winner must pay the full amount within 24 hours, by the deadline shown to them; if they do not, their bid is in default and the lot may be offered to the next-highest bidder. A seller can withdraw an auction until bidding opens. Once bidding has opened, it cannot be withdrawn, even if it has no bids; after that only LO can stop it, and only for a reason it must act on, for example because the managing body can no longer transfer the week, the seller's identity check fails, the listing turns out to be wrong, or the law requires it. Auction finality and any cooling-off rights are subject to South African law.

Identity (FICA)

You must be 18 or older, and we need your ID before you can bid or buy, never just to browse.

You may hold only one member account with mydreamholiday. If we find that one person holds more than one account, we may refuse to verify the extra account, suspend it, or close it. We will not close an account that has bids, lots, offers or payments without first contacting you. Bids made from an account that should not exist may be cancelled.

Off-platform dealing

While a listing is live with us, the seller agrees not to sell the same interest elsewhere. If a buyer and seller who were introduced through mydreamholiday agree a sale of that interest outside the platform within 6 months after the introduction, the seller commission and the buyer's fee are still payable to LO as if the sale had been made on the platform.

Liability

Except where caused by LO's own gross negligence or wilful misconduct, LO is not liable for the accuracy of listings, the conduct of buyers, sellers or managing bodies, or transfer delays. Nothing in these terms excludes rights you have under the Consumer Protection Act.

Disputes

Please contact us first at support@mydreamholiday.co.za. Unresolved matters may be referred to the Consumer Goods and Services Ombud (www.cgso.org.za) or the Property Practitioners Regulatory Authority (www.theppra.org.za), and privacy complaints to the Information Regulator (inforegulator.org.za).

Changes

We may update these terms on notice. A change applies only to transactions concluded after it takes effect; anything you have already signed, bid on or bought stays on the terms you accepted. South African law applies.
